Video: Criminal Defense Strategies on DWI Cases

There are a lot of things that can be done in a DWI case. The prosecution has to prove that the defendant was operating a motor vehicle while intoxicated. So sometimes, there are issues if the defendant’s not in the car. When police show up, whether they were operating the vehicle, if that can be proven. And, of course, there’s the issue of whether they were, in fact, intoxicated.
And so, for example, even if there’s a blood or a breath test, frequently those have problems. Sometimes the video is really good for the defendant, but the breath or the blood test showed that he failed. So, obviously, that raises an issue of whether the breath or the blood test is reliable. There’s an issue whether police legally stopped the defendant.
So there are a lot of different defenses that can be used in DWIs and we’ve had a great deal of success in these cases, particularly in getting them dismissed.
