Defending the rights of people in Houston, Harris County and throughout Texas in state and federal courts
Though the Constitution holds that an accused person should be considered innocent until proven guilty, when it comes to a child sex crime, many people automatically tend to presume that an accused person is guilty. Family and friends may cut them off, and employers may balk at keeping them on the payroll.
In child sex cases, prosecutors and judges also tend to take a harsh position. Why?
In Texas, District Attorneys and judges are elected. That means they do not want to appear soft on crime, particularly crimes involving children. As a result, someone accused of a child sex crime needs a highly skilled and experienced attorney who knows how to handle these types of cases and to fight on their behalf.
That’s because, no matter how strongly an accused person denies such allegations, others may be quick to condemn or dismiss them. Such persons need someone who will speak up for them, give them hope, and fight for them every step of the way.
With over 25 years of experience, Houston sex crime defense attorney Neal Davis believes that you are entitled to respect, discretion and an expert defense. The Neal Davis Law Firm is a top-rated criminal law firm in Houston focusing on child sex offense cases.
Neal has dedicated his life and career to helping people in difficult situations by providing a client-centered approach in his practice and offering the same level of service and attention to each case.

Here’s one Neal Davis client who avoided conviction in a continuous child sex abuse case:
The Neal Davis Law Firm won a victory in State v. R.V., in which our client was charged with continuous sex abuse of his stepdaughter. A continuous sex abuse of a child charge is a very serious offense, carrying a possible sentence of 25 years to life in prison. There is no probation or parole for this sex offense.
In the case, which was personally handled by widely respected Houston child sex offense attorney Neal Davis, the stepdaughter was 8 years old at the time of the alleged abuse. Her mother was supposedly an eyewitness to some of the abuse and testified about it.
The complainant, who was 10 years old at trial, testified she was abused for over a year.
The prosecution called several expert witnesses on child sex abuse, but thorough cross-examination destroyed their credibility.
The trial lasted approximately three weeks. The State had such little confidence in the case that, right before jury deliberations, it asked for a less serious offense of indecency with a child.
Neal Davis prepared a presentation of 25 reasonable doubts that he discussed with the jury.
Almost immediately the jury rejected the continuous sex abuse charge. The jury deadlocked (9-3 in favor of acquittal) on the lesser offense of indecency with a child.
A mistrial was declared, and the client went home. He remains a free man today.
What others say
“This man saved my life from false imprisonment.
Neal’s belief in ‘liberty and justice for all’ as laid out in the Constitution of the United States, and especially as that principle relates to constitutional rights regarding the receipt of a fair trial, coupled with his refusal to quit fighting, are attributes of a noble spirit and a man of high character.”

“Neal is the best attorney anyone could ever want. We started out in a situation we thought we would never be in with our child and a parent’s worst nightmare. Our son made a mistake while suffering from PTSD, and at first, we had a horrible attorney and things just didn’t feel right with her so we prayed for God to send us the right attorney. Neal was that perfect attorney we needed. His devotion to our son and his case was phenomenal. He was very professional and knew exactly how to handle his case to get the job done. He kept fighting for our son, and we will forever be in his debt for that. If you need an attorney that will care about you and fight for you then Neal is who you want and he is worth every single penny! We pray blessings over him and thank God for him every single day.”

Why child sex offenses are different
First, the public views child sex crimes as worse than any other offense.
Many presume that someone charged with a child sex offense is guilty, effectively putting the burden on the accused to prove their innocence.
This presumption of guilt is the opposite of what our justice system requires—that the prosecution prove its case beyond a reasonable doubt.
Second, the public generally believes—and wants to believe—a child’s word when it comes to being sexually assaulted.
Many do not think a child would make a false allegation about something as serious as molestation. Adults lie about big things, but kids don’t… or so the thinking goes.
Third, child sex crimes are political hot potatoes for the District Attorney’s Office.
In Texas, District Attorneys are elected. They want to appear “tough on crime,” particularly in certain types of cases that are highly politicized.
Family violence and DWI are two kinds of politically charged cases. Sex crimes are definitely a third.
This means that—unless the case is such a dog that the prosecutor has zero chance of winning—the District Attorney’s Office would much rather take a sex case to trial AND LOSE than dismiss the charges.
The political calculus is this: a fight that results in a loss is better than dismissing a case and looking weak, even if the dismissal is justified due to weak evidence.
Finally, a criminal defense attorney must be uniquely qualified to handle child sex crimes.
The way these cases are investigated and tried is different from any other type of case—from how to address them during the investigation phase to how to cross-examine the child complainant at trial.
Child sex crimes also have specific evidence and procedure rules unique to them. The range of punishment in these cases depends on the charge. Further, upon conviction, sex offender registration is required, sometimes for life.
Neal Davis has tried almost every type of criminal case—from low-profile misdemeanors to high-profile murders—and can personally attest to the special challenges of sex crimes cases. Only a small number of lawyers in Texas know how to handle sex crime cases properly. That is why it is imperative that someone accused of a child sex offense hire the best lawyer for the job.
If you are being investigated for a child sex offense, you need to contact an experienced attorney who has been recognized as among the best.
